  • Application for granting a permanent residence permit;
  • Application for granting an EU long-term resident permit;
  • Application for granting a temporary residence permit (with restrictions);
  • Application for issuance of a CUKR residence card.
  It is not possible to submit an application in MOS for a temporary residence permit:
  • for the purpose of performing work within the framework of an intra-corporate transfer (Art. 139a para. 1);
  • for the purpose of long-term mobility of a manager, specialist or trainee, within the framework of an intra-corporate transfer (Art. 139o);
  • for the purpose of family reunification – in the situation where the foreigner resides outside the territory of the Republic of Poland (Art. 159 para. 1);
  • for a family member of a Polish citizen or an EU member state citizen – when the foreigner resides outside Poland (Art. 160 pts 1, 3, 4 or 6);

 

 

Applications for residence permits and CUKR residence cards can only be submitted electronically via the MOS- using the form provided at the MOS.

Submitting the application in any other way will result in itsto be left out.

 

  Exceptions for temporary residence permits

Not every type of application for a temporary residence permit can be submitted through the MOS - you will not submit an application at the MOS:

  • where the unit receiving the alien is responsible for submitting the application- These are temporary residence permits for the purpose of work in the framework of an intra-corporate transfer (Article 139a(1)) and for the long-term mobility of a manager, specialist or trainee employee in the framework of an intra-corporate transfer (Article 139o);
  • where the foreigner is staying outside the territory of the Republic of Poland, and the application is submitted by the member of his/her family residing in Poland whom he/she intends to join - in the case of a temporary residence permit for the purpose of family reunion (Article 159(1)) and a temporary residence permit for a family member of a Polish citizen or a citizen of an EU Member State (Article 160(1), (3), (4) or (6)).

Residence permitis the entitlement to legal residence in Poland, which is granted to third-country nationals (non-EU, NO, IS, LI, CH) and stateless persons upon their application, on the basis of an administrative decision issued by the provincial governor or the Head of the Office for Foreigners (under an appeal procedure).

As a result of granting this powerA residence card is issued as an identity document.

The residence card not only confirms the entitlement to stay, but also allows - subject to the possession of a valid travel document - tocrossing the Polish borderwithout the need for a visa, if required, or to observe the permitted period of visa-free travel. Provides also the basis for travel within the Schengen areafor a period of 90 days in any 180-day period.

  • Temporary residence permit - granted for a period from 3 months to 3 years, depending on the main purpose of stay. It is the primary means of legalising the stay of foreigners in Poland.

  • Permanent residence permit - granted indefinitely on the basis of national provisions, mainly to persons with a Pole's Card, Polish ancestry or whose indefinite stay is justified for family reasons. The residence card is issued for a period of 10 years.

  • Residence permit for a long-term EU resident - granted indefinitely. It is regulated at EU level - Directive 2003/109/EC on the status of long-term residents. It is granted if one proves, as a rule, at least 5 years of legal and uninterrupted residence in Poland and proves that he/she has the legal title to the dwelling he/she occupies, adequate income, insurance and knowledge of the Polish language confirmed in a specific manner.

  • You will not complete the application electronically at the MOS,if you are not a user logged in at MOS. To complete the application you must log in to your individual MOS account via your login.gov.pl profile;

  • You will not send an application in the MOS if you do not have a trusted signature or a qualified electronic signature (or personal signature - if you are a citizen of the Republic of Poland and you are applying on behalf of a minor or an incapacitated person); 

  • Submit your application during your legal stay in Poland -submission of an application from abroad is not permissible, and only a few exceptions allow you to apply if you are in Poland illegally.

  • Be sure to check before applying for authorisation,whether, in the situation you are in, it is generally possible to initiate proceedings and whether there are grounds for refusing to grant authorisation. If there are such grounds, consider whether to apply for authorisation.

 

  • an adult foreigner;
  • the parent of the minor foreigner – for that minor foreigner;
  • guardian of the foreigner – for that foreigner;
  • guardian of an unaccompanied minor foreigner - for that unaccompanied minor foreigner.

In general terms, every foreigner who:


  • at the time of submitting the application is an adult,
  • has full legal capacity,
  • resides in the territory of Poland,
  • posiada indywidualne konto w MOS i pozostaje zalogowany na to konto and
  • has a trusted signature in a trusted profile or a qualified electronic signature;

- as well as a parent or guardian of the minor foreigner, a guardian of the foreigner and


  •      posiada indywidualne konto w MOS i pozostaje zalogowany na to konto and
  •      posiada podpis zaufany w profilu zaufanym, kwalifikowany podpis elektroniczny or podpis osobisty.

 

Depending on the situation in which the foreigner finds himself, the proceedings on the application may not be initiated or the voivode may refuse to grant the permit. To avoid such a situation, the conditions to be met must be checked before submitting the application.

The regulations prohibit the use of other Users' accounts. At the same time the user is obliged to maintain confidentiality of data necessary to log in to the portal, and therefore may not share them with third parties, including a representative. 

A proxy may, however, participate in the application completion process in such a way that the application is completed by the foreigner in their presence.

 

In the case of an adult foreigner, the regulations require personal signing of the application with a trusted signature or a qualified electronic signature, except for the situation of a person who has been fully incapacitated – on behalf of such a person, the application in MOS is submitted by their court-appointed guardian.

In the case of minors, the application is filled in and submitted in MOS on behalf of the minor foreigner by his parent or guardian, and on behalf of the unaccompanied minor – by his guardian. They may sign the application with a trusted signature or a qualified electronic signature, or (if they are Polish citizens) with a personal signature.

An adult foreigner or a parent, guardian or curator acting on behalf of a foreigner gains access to completing and submitting the application in MOS through an individual account in MOS.

This is contrary to the regulations.

By sharing your login credentials you must be aware of the risk of them being used in a way beyond your control.

Before submitting an application


Before submitting an application, the applicantcan return to it again and againto edit it - to make new content or changes. 

Once the application has been submitted


Once an application has been submitted through the MOSIt is only possible to make corrections to this application by making handwritten changes to the hard copy.Each amendment should bear the handwritten signature of the applicant and indicate the date of the amendment.The application may be corrected in person when appearing in person at the provincial office when summoned by the provincial governor, or in accordance with the provincial governor's summons by sending the corrected version by post or by depositing it at the provincial governor's office.

The MOS provides the opportunity to:

  • the electronic submission of the application for a residence permit (with exceptions that require the submission of a paper application), and
  • to send a certificate of application (if any)

- but at the momentdoes not provide further electronic handling of this request via the portal. 

Step 1 Pre-filling of the application


If you are applying for a temporary residence permit:

  • temporary residence and work permit
  • in order to work in a highly qualified profession (Blue Card)
  • for business purposes (if the purpose of residence is work)
  • for a trainee
  • for the volunteer
  • for the purpose of study

-when completing the application, you will be required to make an attachment form electronically available for the application to be completed:

  • employers,
  • to the internship provider,
  • the organisational unit for which you are to provide services as a volunteer or
  • the unit conducting the studies.

In order for an attachment to be available, in the appropriate place on the application formprovide the e-mail address of the recipient of the attachment(e.g. your employer) and confirm by clicking on theAdd button.

Thencomplete the applicationfor authorisation in the part that has not yet been completed.

Step 2: Sending an attachment


When you have finished, click "Save application and submit employer form". (analogously to other entities - depending on the permit you are applying for)

An important message. It confirms that the form has been submitted (e.g. to an employer) and indicates that the application process for a temporary residence permit has not yet been completed:

« This is not the end of the work on the application. You will be able to sign and send the application once you have received the completed Annex 1 application form.for a temporary residence permit from the employer. The form has been sent to the employer at the email addresses provided as a link. We recommend that you contact your employer to expedite the completion of the form. If the employer sends back the form, you will receive an email notification and will be able to sign and send the application.»

After going to "My Documents"the status of the application will be displayed next to the indicated application:

 « Awaiting completion of attachment by employer».

Stage 3 Employer action


The employer (or other entity), will receive a link to the email address you provided. When you follow the link, it will open a form to fill inin electronic form.

Once he or she has completed the form electronically, he or she will sign it with a trusted signature, a qualified electronic signature or a personal signature via login.gov.pl and send it in the MOS,The attachment will automatically be added to the application.

Step 4. Completion of the application by the foreigner


You will then receivenotification to your e-mail addressabout the possibility of completing the application process at the MOS.

Beyond:

  • a photograph in digital format (jpg format);
  • digital reproduction of all pages of the travel document (pdf format);
  • and the annexes required (obligatory) for certain types of temporary residence permits and the title to the premises - in the case of a long-term resident's EU residence permit

- regulations do not requirethat, when you apply for a residence permit (temporary, permanent, resident status), you enclose the other documentation required for your application to be processed -although you can do this to speed up the proceedings.

According to the Aliens Act, once you have sent in your application at the MOS, you will be summoned by the provincial governor to supplement your application with the documents needed to demonstrate that you meet the requirements relevant to the granting of the permit. Follow the contents of the summons. It will specify what documents you need to provide, specify the deadline by which you need to do so and specify the manner in which you need to provide them (the provincial governor may consider it appropriate to provide them when appearing in person at the provincial office).
